Prisoners do not have a constitutional right to DNA testing after their conviction, the Supreme Court ruled yesterday, even though the technology provides an “unparalleled ability both to exonerate the wrongly convicted and to identify the guilty.’’

A way to positively prove innocence/guilt, and they won't let the man take a test to prove it, instead he has to stay in jail ?

"Alito and Kennedy would go further than Roberts, holding that anyone who waived DNA testing at trial for tactical reasons has no right to pursue it after conviction."

“A criminal defendant proved guilty after a fair trial does not have the same liberty interests as a free man,’’ he wrote, and thus states have more “flexibility’’ in deciding procedures for postconviction relief." - John Roberts

The second statement bears an extreme logic gap. "a criminal defendant PROVED guilty"...how the fuck is he PROVED anything is all the facts weren't in.

And what the fuck happened to "Innocent until PROVEN guilty" it doesn't say "Innocent until FOUND guilty" The difference is the difference between light and day.

Fuck this country. We're fuckin facists.

pretty fucking pathetic man, i mean, the guy that killed my uncle is in prison, and even i have a pretty strong stance on shit like this with guys behind bars

i kinda think Dante Stallworth got off pretty damn easy, killed a guy with his car when he was driving drunk, and he only gets 30 days in prison, i understand he's got 2 years house arrest and shit, but still, michael vick killed dogs and he got fucking 2 years

The difference is, the dude Stallworth killed ran out in front of Stallworth's car - yes, there are witnesses - I think it highly probable that even if Stallworth was stone cold sober, he would have killed teh guy.

yeah i agree but still, he killed a guy, i'm not saying i want the guy locked up for life or anything, he was drunk and his reaction time was more than likely impaired, he had a fucking 1.2 blood alcohol rating for christs sake, he was FUCKED UP you know? usually for that alone you'd get more than 30 days in jail

Exactly - when I heard that they settled out of court - with his insurance, no less - instead of taking him to court, I knew he would get a light sentance.

I know if someone in my family was killed, i wouldn't settle on 30 days for some money honestly, i know you can't judge how you'd respond until you're in the situation, but i've had a family member that was killed, and had to go through similar scenarios, and i know for the most part what i would do

I do udnerstand, and I know exactly what I'd do if somebody killed a member of my family - and it don't involve a lawyer.
